Substantial Confidential Settlement Attained for Trip and
Fall Injury

A substantial settlement was achieved for a 65
year old male client of Clete Blakeman
and Blakeman Law pc during negotiations
on a claim involving a trip and fall incident
on a business property. The client, a
post-polio survivor, was injured while walking
across the parking lot of a local company. He
tripped and fell over a 4” high dome-shaped
piece of concrete extending up from the lot.
The allegations against the property owner were
that the protrusion was not readily apparent to
users as its color blended with the rest of the
parking lot. Furthermore, it was not marked,
painted or identified in any way to warn users
of the lot. Among all his injuries, the client
suffered a broken knee which required surgery.
He was placed under general anesthesia and put
on a ventilator during the procedure. Although
the surgery was successful, the client
developed postop complications. Because of his
post-polio respiratory limitations, the
complications were magnified and led to him
becoming ventilator dependant via a permanent
tracheostomy and also has rendered him unable
to walk independently. Although the terms of
the settlement are confidential, the client and
his family were very pleased by the result
achieved through the work of Clete Blakeman. |
